Indemnification                                

You agree to defend, indemnify and hold Talita Kum, LLC DBA 'Zante' harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of our site. 

Governing Law

The laws of the State of Texas govern the  and the Terms and Conditions of this Agreement, without regard to choice of law principles.

Severability

If any one or more of the provisions of these Terms & Conditions shall be for any reason whatsoever held invalid, then such provisions shall be deemed severable from the remaining provisions and shall in no way affect the validity or enforceability of the other provisions of these Terms & Condition

Cancellation

A Talita Kum, LLC DBA 'Zante' member that has made an appointment for a session may cancel or change the time of the session provided that a minimum of 24-hours notice is given by contacting us directly. Members will be charged for the full cost of the session on any late cancellations or no-show appointments.

Expiration

All sales are final. All sessions expire six months from the date of purchase, but some have shorter expiration periods. All class passes expire within 30 days from the date of purchase if purchase price, or class pass value, is under $250 and within 60 days from the date of purchase if purchase price, or class pass value, is over $250.  All purchases, whether of sessions or class passes, are non-transferable and may only be used by the buyer. 

Liability Waiver

I, the undersigned, for myself and my heirs and legal representatives forever release the Talita Kum, L.L.C. DBA 'Zante', its employees, agents, their respective heirs and legal representatives from any damages, claims, demands, rights and causes of action of whatever kind or nature based upon personal injuries, death or property damage to me, whether or not caused by negligence, errors or omissions of Talita Kum, L.L.C. DBA 'Zante' its employees or agents or third parties or myself.

I, for myself and for my heirs and legal representatives agree to indemnify Talita Kum, L.L.C. DBA 'Zante', its employees, agents their respective heirs and legal representatives against, and save them harmless from all damages, actions, causes of action, claims, judgements, executions, debts, cots of litigation and attorney fees which may in any way arise out of or result from my participating in Talita Kum, L.L.C. DBA 'Zante' activities even if the damages are caused by the negligence of Talita Kum, L.L.C. DBA 'Zante', its employees or agents or third parties or myself.

I certify that I have read the foregoing instrument, that I understand its terms and conditions, that I make this waiver voluntarily, and that I have not relied upon any representatives made by Talita Kum, L.L.C. DBA 'Zante', or its officers, agents, officials, or employees in signing this document. 

I further certify that I am an adult.
